It has taken time, but former Miami Dolphins head coach Brian Flores is beginning to see the results of filing a racial discrimination class action lawsuit against the National Football League. However, not all the results are to his liking. Flores was fired by Stephen Ross, the owner of the Dolphins, at the end of the NFL’s regular season last year, despite giving the Dolphins back-to-back winning seasons, a feat not seen in South Florida for two decades. On Feb. 1, Flores filed his original lawsuit in Manhattan, a decision largely based on his experiences interviewing for new coaching jobs, for the Denver Broncos and the Buffalo Bills, after the firing from the Dolphins. Flores alleges in the lawsuit that his experience included “sham interviews” held … [Read More...]

Bill Proposed for Supreme Court Term Limits
The world has changed by leaps and bounds since the Supreme Court began meeting in 1790, but some things have not changed, including the country’s loyalty to the U.S. Constitution. However, there is a movement in Congress to rework a major piece of the Constitution – how the highest court in the land operates. On July 26, Rep. Hank Johnson, D-Ga, introduced the Supreme Court Tenure Establishment and Retirement Modernization (TERM) Act to the House of Representatives. The proposed legislation would do away with the Supreme Court justice’s lifelong term and instead require an 18-year term limit. The TERM Act would also have the president nominate a new justice every two years, in the first and third years after the presidential election. When the new individual takes their … [Read More...]
Legal Battles to Emerge with Overturning of Roe v. Wade
When the 1973 landmark case Roe v. Wade was overturned on June 24, countless advocates began wondering what other legal ramifications may come into play. At least 25 states are now certain or highly likely to ban access to abortion care. As Roe v. Wade was overturned, 13 states have trigger laws that come into play. In the concurring opinion, the Supreme Court justices stated that the decision that permitted abortions before a fetus is viable outside of the womb was incorrectly decided because the Constitution makes no specific reference to abortion rights. Justice Kavanaugh included this as part of the concurring opinion, “The Constitution neither outlaws abortion nor legalizes abortion.” Furthermore, Justice Clarence Thomas discusses that the court should revisit previous rulings, including state laws that protect the right … [Read More...]
Can Parents of Minors Involved in Mass Shootings Legally Be Held Responsible?
In Illinois, you must be 21 years old in order to apply for a gun permit. But in 2019, Robert E. Crimo III was too young to apply independently for a gun license. His father sponsored the application, which gave his son access to purchasing and owning weapons. The Illinois State Police reviewed the application and determined there was no reason to deny the application. After all, Crimo had no serious mental health issues, no criminal record, no arrests, no orders of protection, and no other behavior that would disqualify his application. On July 4, Crimo opened fire at an Independence Day parade and celebration, killing seven people and wounding more than 30. By the time Crimo had access to weapons through his co-sponsored application, he had already encountered law … [Read More...]
Can Lawsuits Be Filed Against Uvalde Gun Maker?
On May 24, an 18-year-old gunman stormed Robb Elementary School, killing two teachers and 19 students before law enforcement killed the shooter. The gunman purchased his first gun legally on his 18th birthday, only one week before the shooting. While a nation tries to make sense of another school shooting, experts have begun to weigh in on what legal action may be available to hold those accountable for the school shooting. In the case of the Uvalde shooting, with the shooter killed, there are limited legal avenues that families can explore. Protection of Lawful Commerce in Arms Act Gun manufacturers are protected under a federal law known as the Protection of Lawful Commerce in Arms Act (PLCAA). How Does the Supreme Court Nomination Process Work?
Since Supreme Court Justice Stephen Breyer announced his retirement in January after nearly 28 years on the bench, experts have been speculating who will take his place. President Joe Biden promised during his presidential campaign to place a Black woman on the court when a vacancy opened; he reiterated that vow after Justice Breyer’s announcement. This would be the first time a Black woman has served on the country’s highest court. President Biden is expected to announce his candidate for this historical role by the end of February. The Search For the Next Supreme Court Justice President Biden has said that the next Supreme Court Justice will need to fill the large shoes left behind by Justice Breyer, who he called “a model public servant at a time … [Read More...]

Samuel Bush became emotional as he recalled walking by a woman crying and saying she couldn’t breathe. “I was trying so … [Read More...]

In September, the Cherokee Nation reached a settlement agreement with three of the largest opioid distributors in the country. AmerisourceBergen, Cardinal Health and McKesson have agreed to pay $75 million to the Cherokee Nation in Oklahoma for their role in the opioid epidemic. New Texas Abortion Law Allows Citizens to Sue
On September 1, the Texas abortion restriction law known as SB8 or the Texas Heartbeat Act went into effect. This new Texas law restricts the timing of abortions to before fetal cardiac activity can be detected on an ultrasound. It is estimated that this can be around 5-7 weeks of pregnancy. The challenge with this is that most women are unaware that they are pregnant at this time. This law conflicts with the Supreme Court’s previous rulings that only permit abortions up to the gestation of 22-24 weeks. Up to this time period, a fetus is not viable. It’s expected that this law will restrict 85{da2ef7ff2781dfb5887db3e3a6cf03c7c894e23a27536de3f64bd799872794d1} of abortion procedures in Texas. This law effectively bans abortion for everyone once an electric activity has been seen on an ultrasound. If the … [Read More...]
Were Patients Notified of the Paragard IUD Label Change?
The Paragard IUD is well-known as a long-term form of birth control. What Options Do Sleep Apnea Patients Have With CPAP Recall?
In June, Philips Respironics issued a product recall for specific ventilation devices and devices that treat sleep apnea due to a potential health risk. The devices were manufactured between 2009 and April 26, 2021. The recall is due to issues related to the polyurethane foam that may degrade and enter the device’s air pathway. Once in the air pathway, the particles may be inhaled by the device user. Additionally, the foam may off-gas chemicals during use. Unapproved cleaning methods may increase foam degradation. These issues could result in serious health concerns, including difficulty breathing and cancer.
